Update on on-the-spot import & export topic: The National Assembly Grants Official Approval
On June 25, 2025, the National Assembly enacted a new law which introduces amendments to eight existing laws concerning finance, bidding, and investment. This law becomes effective on July 1, 2025.
Following the enactment of the new Law, on June 30, 2025, the Government issued Decree No. 167/2015/ND-CP to provide guidance on the new Law's provisions regarding Customs Procedures.
Accordingly, the new Law (Law no. 90/2025/QH15) formally adds the definition of "on-the-spot exported and imported goods" to the Customs Law. It also amends the current VAT Law to classify "on-the-spot exported goods" as eligible for the 0% VAT rate.
However, the Law's transitional provisions specify that these changes apply only to Customs declarations that were registered but not fully cleared before July 1, 2025.
