Regulations of the Invoice - Based Fiscal Lottery
Fiscal Lottery Basis
All natural persons who deposit one or more sealed envelopes—containing the documents specified in this decree—into the boxes designated by the Ministry of Economy and Finance, through the Gaming Control Board, may participate.
The envelopes may only be opened at the time of the fiscal lottery, in the presence of a Notary Public and an official from the Gaming Control Board.
Public servants from the Gaming Control Board and the General Directorate of Revenue are not eligible to participate in the fiscal lottery.
Once the mechanism for a digital fiscal lottery is enabled, participation will be possible by submitting invoices electronically, in accordance with the procedure established for that purpose.
Awards
Each fiscal lottery will award a total of twenty-five (25) prizes, distributing a total of one hundred ten thousand dollars (110,000.00 USD):
- 5 prizes of ten thousand dollars (10,000.00 USD) each, for a total of fifty thousand dollars (50,000.00 USD).
- 10 prizes of five thousand dollars (5,000.00 USD) each, for a total of fifty thousand dollars (50,000.00 USD).
- 10 prizes of one thousand dollars (1,000.00 USD) each, for a total of ten thousand dollars (10,000.00 USD).
Invoices on envelopes
The envelopes must contain at least five invoices or equivalent documents issued to customers by people required to issue fiscal invoices. The invoices must be in the name of the person participating in the fiscal lottery.
The invoices or equivalent documents must meet the following conditions:
- Be issued by authorized fiscal equipment.
- In the case of electronic invoices, they must be properly printed.
Only invoices issued up to two months prior to the date of the fiscal lottery will be accepted.
The invoices included in the envelopes must contain the following information:
- Title of the document (invoice or equivalent).
- Unique numbering per billing point.
- Registration number of the fiscal equipment.
- Name, address, Taxpayer Registration Number (RUC), and Verification Digit of the issuer.
- Name and identification of the recipient (ID card or passport; the name and identification number may be written on the back of the invoice).
- Date of issue (day, month, and year).
- Description of the transaction, including quantity and amount (quantity may be omitted when not applicable).
- Breakdown of applicable taxes (ITBMS, ISC, others).
- Individual and total value, including date and method of payment.
- Details of discounts, bonuses, and adjustments.
Each envelope must clearly and legibly display the following information on its exterior:
- Full name of the sender.
- ID number (for Panamanians), permanent resident card issued by the Electoral Tribunal, or valid passport (for foreigners).
- Physical address.
- Email address.
- Phone number
Fiscal Lottery process
At least four fiscal lotteries will be held annually on the dates specified by the Ministry of Economy and Finance.
Envelopes deposited up to seven days prior to the fiscal lottery date in the designated boxes will be transferred to the central offices specified by the Ministry of Economy and Finance.
The fiscal lottery will be public and held at a location designated by the Ministry of Economy and Finance, in the presence of a Notary Public, who will certify the process.
The same person may win more than once if multiple envelopes in their name are drawn.
Envelopes that are not selected will be destroyed in the presence of an official from the Gaming Control Board.
- The winners should present the following documents:
Valid personal identification card (for nationals), permanent resident card issued by the Electoral Tribunal, or valid passport (for foreigners). - The winner's bank account number, where the prize(s) will be deposited.
- Certification of the winner’s bank account, stamped and signed by the issuing bank.
Fiscal benefit
The prizes are exempt from income tax, in accordance with paragraph (g), Article 708 of the Fiscal Code.
