New Bill for the “dignification of work”

The new Bill 409 of 2025, filed last March 25 in the Senate, aims to “guarantee the dignification and protection of labor rights”, covering essential aspects related to mandatory rest days, holidays and night work, among other modifications.

One of the most relevant transformations is that of article 160 of the Substantive Labor Code, which defines working hours, in which it is proposed that day work will be performed between 6:00 a.m. and 8:00 p.m., and night work from 8:00 p.m. to 6:00 a.m. the following day. In addition, article 161 introduces that work between 8:00 p.m. and 9:00 p.m. will not be considered night work in sectors with mostly night activity.

Regarding remuneration on mandatory rest days, a surcharge of 100% over the ordinary salary is proposed for work on holidays or mandatory rest days, applicable gradually from July 2025 to 2027.

Finally, micro-companies will be allowed to make partial social security payments, provided they formalize their legal existence. It also creates a special contract for medical interns with minimum conditions of economic support, affiliation to labor risks and shifts of up to 12 continuous hours.

The law would enter into force after its enactment, repealing contrary provisions.
