Oct. 2025 - A new paid caregiving leave is introduced in Shanghai

In order to effectively alleviate the burden on family caregivers and protect the rights of the elderly, Shanghai has introduced the first significant amendment to the Regulations on the Protection of the Rights and Interests of the Elderly in Shanghai in nearly a decade.

Application Scope

  • The leave is available exclusively to the providers of support (i.e., children) for elderly people, and only when the elderly person is hospitalized for medical treatment

 

Number of leave days

  • Non-only children: up to 5 workdays in total each year
  • Only child: up to 7 workdays in total each year

 

Treatment of salary

  • Employees shall receive their full salary based on normal attendance standards during the care leave period, with no deductions allowed

 

Effective Date

  • This regulation is effective as of 1 November 2025

 

Action recommended

  • Refine internal systems and clarify application procedures in advance
  • Standardize leave management and retain key supporting documents
  • Coordinate work flexibly to minimize impact on operations
