Hiring of foreign nationals from 1 October 2025
As of 1 October 2025, the amended version of Act No. 435/2004 Coll., on Employment, will come into effect, introducing the concept of undeclared work. An employer commits an offence by allowing undeclared work to be performed if they fail to fulfil their obligation to inform the regional branch of the Czech Labour Office about the commencement of employment of a foreign employee in a timely manner, i.e. no later than before the commencement of employment (Section 87(1)). Until now, it has been stipulated that the commencement of employment of a foreign national must be reported no later than on the day of commencement. The Czech Labour Office is currently sending employers an interpretation of this provision, stating that it is the employer's obligation to inform the Czech Labour Office of the commencement of employment of a foreign worker no later than before their first day at work.
Czech Labour Office Employers may be fined up to CZK 3,000,000 for failing to comply with this obligation.
