SEC rules on offering digital tokens and assets
Following the Royal Decree on Digital Asset Businesses, 2561 B.E. (2018 A.D.), the Securities and Exchange Commission (“the SEC”) has issued rules on the criteria for obtaining permission to conduct business offering digital tokens to the public and offering digital assets.
Changes to the Foreign Business Act Proposed
The Department of Business Development (“the DBD”) has decided to propose the removal of the following five service businesses from List Three* of the Foreign Business Act, 2542 B.E. (1999 A.D.) (“the FBA”).

Digital Asset Business
The control of the digital asset business is currently the responsibility of the Minister of the Ministry of Finance and the Securities and Exchange Commission (“SEC”), in accordance with the Royal Decree on Digital Asset Businesses, 2561 B.E. (2018 A.D.) (“the Royal Decree”), which was published in the Royal Gazette on 13 May 2018, and became effective on 14 May 2018.
Registration number for foreign legal entities
In 2017, the Ministry of Commerce published Ministerial Regulation on Service Businesses, Representative Office, and Regional Office not required to apply for a Foreign Business Licence.
