Employee Welfare Fund: Deadline reminder

Contribution collection starts on 1 October 2026. The first payment, covering October payroll, is due by 15 November 2026. Employers should confirm coverage, prepare employee data, update payroll and complete registration before the deadline.

The Employee Welfare Fund (EWF) is a statutory scheme under Thailand’s Labour Protection Act B.E. 2541 (1998). It provides financial support to eligible employees when employment ends or when an employee dies. Employers within scope must deduct employee contributions, pay matching employer contributions and remit both amounts to the Department of Labour Protection and Welfare (DLPW).

Important: Contributions are calculated on wages, including performance-based wages where applicable. The law does not prescribe a minimum or maximum wage ceiling for this calculation. 

Filing opens: The DLPW has announced that employers may submit contribution information through the EWF system from 1 November 2026. 

 

2. Who must participate? 

As a general rule, employers with 10 or more employees must participate unless an exemption applies. 

  • Employers may be outside the mandatory scheme if they fall within a legally exempt category, including certain non-profit activities, household employment without a business element, and other categories specified by labour law. 
  • An employer may also be exempt for employees who are fully covered by a qualifying provident fund or another compliant welfare arrangement that provides benefits when employment ends or the employee dies. 
  • If provident fund membership begins only after probation, employees who are not yet covered may still need to be registered with the EWF. An employer may therefore need to operate a provident fund and the EWF at the same time. 

Employers with fewer than 10 employees: Participation may be available on a voluntary basis, subject to the applicable employee agreement and DLPW approval requirements. 

 

3. What employers must do 

Confirm coverage: Review headcount, legal exemptions and whether every eligible employee is covered by a qualifying provident fund or welfare arrangement. 

Register and submit employee data: Use the DLPW EWF e-service and prepare complete employee information, including names, identification or passport numbers, start dates and wage details. 

Update payroll: Configure the correct contribution rate, employee deduction and employer matching contribution from October 2026 payroll. 

Pay by the monthly deadline: Remit both employee and employer contributions by the 15th day of the following month. The first payment is due by 15 November 2026. 

Keep records current: Maintain supporting records and promptly update new hires, departures, wage changes and employer information as required. 

 

4. Consequences of delay or non-compliance 

Non-compliance may create criminal and financial exposure 

Failure to submit required information, report changes on time, or providing false information may result in imprisonment for up to six months, a fine of up to THB 10,000, or both. Late or incomplete contributions incur a 5% monthly surcharge on the outstanding amount from the due date until payment. 

A delay can therefore increase cost each month and may also expose the organization and responsible persons to enforcement action. Accurate registration and timely remittance should be treated as a priority compliance obligation. 

 

5. Management checklist before 1 October 2026 

  • Determine which employees must be enrolled 
  • Validate employee identity, start-date and wage data 
  • Review provident fund coverage, including employees on probation 
  • Configure and test payroll deductions and employer contributions 
  • Budget for the employer’s ongoing matching cost 
  • Prepare employee communications and internal approvals 
  • Assign responsibility for monthly filing, payment and compliance monitoring
